Midwest Warranty Claims Attorneys

Minnesota property owners have rights. At Smith Jadin Johnson, PLLC, we are committed to protecting those rights, including those provided for under warranties. Unfortunately, many homeowners and businesses do not assert their rights because they fear they will be unable to take on builders and their insurance companies.

We Can Protect Your Rights Covered Under Warranty

Each lawyer on our team has experience representing general contractors, subcontractors and their insurance companies. As our client, our experience gives you the advantage of being represented by an attorney who can anticipate and counter the defensive strategies these parties may use. Our Minnesota warranty claims lawyers can help you secure recovery for property issues covered under warranties and contacts, including:

  • Residential home warranties: Every residential home built in Minnesota has a statutory, one-year “bumper to bumper” home warranty that covers the entire structure, a two-year home warranty that covers plumbing, mechanical and HVAC issues, and a 10-year warranty that covers structural problems. Minnesota’s Statutory Home Warranties (327A.02) give builders and customers a chance to informally resolve a dispute without trial, and if necessary, the right to bring a lawsuit to enforce those warranties. We help homeowners enforce Minnesota’s Statutory Home Warranties against builders for faulty construction.
  • Commercial construction contracts: Commercial construction contracts often include warranties to protect property owners. We help commercial property owners protect their warranty rights under their commercial construction contracts.
  • Homeowners associations warranties: Under the Minnesota Common Interest Ownership Act, commonly referred to as “MCIOA” (Minn. Stat. 515B), common-interest communities like condominium buildings and townhome associations have a six-year warranty against defective construction. If the developer fails to uphold the terms of the warranty, the association and its members can bring a claim for breach of warranty under MCIOA and, potentially, recover their damages and attorney fees.
From our office in Bloomington, we represent clients in navigating their construction defect litigation needs across Minnesota.
